Terms of Service

1. The Service

MyDataWork is a software-as-a-service workspace for data analysts, BI developers, data engineers, data scientists, and analytics teams. It enables cataloging data files, tracking use cases, visualizing lineage, generating AI recommendations, and exporting reports through the web application and an optional local Connector application with cloud integrations.

2. Eligibility

You must be at least 18 years old and authorized to enter binding agreements. Registration represents that you meet these requirements.

3. Account registration

You must keep your credentials confidential and notify us of any unauthorized access at contact@mydatawork.com. We are not liable for unauthorized account access. Account sharing is prohibited except for authorized Team-plan multi-seat licenses.

4. Subscription plans and pricing

Solo (monthly/annual) and Team (annual) tiers are offered with 14-day free trials; no charges apply during a trial. Pricing may change with reasonable notice. Additional AI credits are available as non-recurring purchases and never expire.

Licences may also be purchased through AWS Marketplace. The AWS Marketplace edition of MyDataWork for Teams is sold as an annual contract covering up to 20 users, with a free trial period, and is subject to these Terms together with the AWS Marketplace terms that govern your purchase. Where the two conflict on matters of ordering, invoicing, or payment, the AWS Marketplace terms control. Larger deployments and custom terms may be offered as a private offer in AWS Marketplace.

5. Feature changes

Features may be added, modified, or removed over time. Material reductions in functionality receive reasonable notice, though specific feature availability is not guaranteed.

6. Billing and payment

Stripe processes payments securely and we do not store card information. Subscriptions renew automatically unless cancelled.

For subscriptions purchased through AWS Marketplace, Amazon Web Services bills and collects payment on our behalf. Charges appear on your AWS invoice under your existing AWS account and payment method; Stripe is not involved and we receive no card or bank details. Renewal follows the term you selected in AWS Marketplace.

7. Cancellation

Monthly plans may be cancelled anytime, with access continuing through the billing period; no partial refunds apply. Annual subscriptions are non-refundable but may be cancelled anytime through Account settings.

Subscriptions purchased through AWS Marketplace are cancelled in your AWS Marketplace console rather than in Account settings, because AWS holds the billing relationship. Cancelling stops the subscription renewing; access continues to the end of the term already paid for, and annual terms remain non-refundable. Refund requests for AWS Marketplace purchases are handled through AWS Marketplace.

8. Account deletion

Permanent deletion is immediate and irreversible, removing all workspace data without the standard 30-day retention. Active subscriptions cancel automatically without refunds. Team admins cannot self-delete without first transferring ownership or removing members.

9. Data retention after cancellation

Following subscription cancellation, account data remains for 30 days before permanent deletion. This retention applies only to cancellation, not to self-service account deletion.

10. Early Access

Early Access programs offer free temporary access at our discretion and may terminate without notice. Early Access does not create any guarantee of continued free access to the Service.

11. Acceptable use

Prohibited uses include unlawful purposes, unauthorized access attempts, reverse engineering, storing malicious code, unauthorized reselling, interfering with the Service, improper use of AI features, and credential sharing outside authorized arrangements.

12. Your data

You retain ownership of all your data. The local Connector application reads only file names, paths, sizes, modification dates, and structural metadata, and never accesses file contents; cloud connectors similarly access only structural metadata. AI features transmit non-content metadata to third-party providers with stakeholder information stripped. Team-workspace content belongs administratively to the workspace under admin control.

13. Data security

We implement commercially reasonable technical and organizational measures to protect data but cannot guarantee absolute security for internet transmission or electronic storage.

14. Service availability

The Service is provided “as is” and “as available” without guaranteed uninterrupted access. We are not liable for outages, interruptions, delays, or errors. Rate limits exist to ensure platform performance.

15. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, MYDATAWORK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

16. Limitation of liability

MYDATAWORK'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. Indirect, consequential, and punitive damages are excluded.

17. Indemnification

You agree to indemnify and defend MyDataWork and its personnel from claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of third-party rights.

18. Intellectual property

The Service, software, design, and content belong to MyDataWork, LLC (Delaware) and are protected by intellectual property laws. You receive limited usage rights only.

19. Modifications to the Service and Terms

We may modify or discontinue the Service with or without notice. Material changes to these Terms are communicated via the website or email. Continued use constitutes acceptance of updates.

20. Termination

We may suspend or terminate accounts for violations of these Terms, fraud, or harmful conduct. Data-retention provisions apply upon termination.

21. Governing law and dispute resolution

Delaware state law governs, without application of conflict-of-law principles. Disputes are resolved by binding arbitration in Delaware, except that equitable relief may be sought in a court of competent jurisdiction.

22. Privacy Policy

Handling of personal information is governed by our Privacy Policy.

23. Entire agreement

These Terms constitute the complete agreement and supersede prior understandings.
