Terms of Service

Which terms apply? These website Terms describe the service and direct subscriptions. For an AWS Marketplace purchase, your accepted offer, its EULA and applicable AWS terms govern that purchase, including warranties, liability, dispute resolution and data retrieval. These website Terms do not override or retroactively amend that agreement.

1. The Service

MyDataWork is a software-as-a-service workspace for data analysts, BI developers, data engineers, data scientists, and analytics teams. It enables cataloging data files, tracking use cases, visualizing lineage, generating AI recommendations, and exporting reports through the web application and an optional local Connector application with cloud integrations.

2. Eligibility

You must be at least 18 years old and authorized to enter binding agreements. Registration represents that you meet these requirements.

3. Account registration

You must keep your credentials confidential and notify us of unauthorized access at contact@mydatawork.com. We are not liable for unauthorized account access. Each member must use an individual account; a multi-seat subscription does not authorize sharing login credentials.

4. Subscription plans and pricing

Explorer plan. Explorer is a free workspace for individuals. Explorer runs for 90 days and is limited to one trial per email address. When your trial ends, your workspace becomes read-only for a further 30 days. That period starts at trial end, not at signup. You can still browse and export your work throughout the read-only period.

Upgrade to a paid plan during the trial or read-only period to keep your work and restore full access. If you do not upgrade by the end of the read-only period, your trial workspace content is scheduled for permanent deletion. Your account and sign-in remain, and you can start a new workspace on a paid plan.

Before deletion, save a JSON export of supported workspace records from Setup → Data portability, or export a PDF or PowerPoint presentation from Portfolio. These exports remain available during the read-only period.

Solo (monthly/annual) and direct Team (annual) tiers are offered with 14-day free trials; no charges apply during the trial. Pricing may change with reasonable notice. Solo and direct Team plans can purchase additional AI credits as non-recurring purchases that do not expire. Explorer and AWS Marketplace plans do not offer these top-ups.

Licenses may also be purchased through AWS Marketplace. Commercial AWS and GovCloud are separate 12-month packages with the capacities stated in the accepted offer. Neither includes a free trial or money-back guarantee. The accepted Marketplace agreement, its EULA and applicable AWS terms govern that purchase; this website does not amend an already accepted agreement. Any private offer is governed by its agreed terms.

5. Feature changes

Features may be added, modified, or removed over time. Material reductions in functionality receive reasonable notice, though specific feature availability is not guaranteed.

6. Billing and payment

Stripe processes direct-plan payments securely; we do not store card information. AWS Marketplace purchases are billed through AWS. Subscriptions renew automatically unless canceled under the applicable subscription terms.

For subscriptions purchased through AWS Marketplace, Amazon Web Services bills and collects payment on our behalf. Charges appear on your AWS invoice under your existing AWS account and payment method; Stripe is not involved and we receive no card or bank details. Renewal follows the term you selected in AWS Marketplace.

7. Cancellation

Direct plans. Monthly Solo may be canceled through Manage billing, with access continuing through the paid billing period and no partial-period refund. Direct annual subscriptions are non-refundable; cancellation stops renewal under the applicable plan terms.

AWS Marketplace. Manage renewal and cancellation through AWS Marketplace under your accepted agreement. Turning off renewal prevents a future renewal; it does not itself end the current contract early. Early termination follows the applicable AWS process and agreed terms. When the agreement actually ends, product access stops. A refund does not itself cancel an agreement, and deleting a MyDataWork account or workspace does not cancel AWS billing.

AWS Marketplace offers have no free trial and no money-back guarantee. Refund requests are considered case by case: contact contact@mydatawork.com. Approved AWS-billed refunds are issued through AWS Marketplace, subject to the applicable offer and AWS terms. Cancellation and a refund are separate actions. Any refund rights provided by applicable AWS policies or law remain in effect.

8. Account deletion

Self-service deletion removes your account from the live service. In a shared Team workspace, contributed work remains with that workspace. Team admins must transfer ownership or remove other members before self-deletion. Deleting a MyDataWork account does not cancel an AWS Marketplace subscription; manage that subscription separately in AWS. Direct annual subscriptions remain non-refundable; AWS refund requests follow the accepted offer and applicable AWS terms.

Explorer is limited to one trial per email address. The eligibility record retained after account deletion contains a one-way hash of the address and the date it was claimed, not the original email address. This record enforces the one-trial limit and helps prevent abuse; deleting your account does not make you eligible for another Explorer trial.

9. Data retention after cancellation

Direct subscription cancellation retains live workspace data for 30 days under the existing direct-plan policy. This is not a promise of automatic deletion on day 30; contact contact@mydatawork.com for retrieval or deletion support. Explorer expiry and its 30-day read-only period are separate, as described in section 4.

For an AWS purchase, the accepted agreement governs retrieval and deletion. Where the agreement incorporates the Standard Contract for AWS Marketplace retrieval provision, the retrieval period is 45 days after termination, or another period agreed in writing; this includes the GovCloud agreement. An administrator should contact contact@mydatawork.com to arrange retrieval or deletion after access ends. Data is then deleted within a reasonable time under the applicable agreement through a reviewed process. Other agreements retain their own terms; a website update does not change them.

Accounts, shared workspace contributions, backups, retained snapshots and audit/accounting records are treated separately in our Privacy Policy. A workspace export is not a complete backup of every system record.

10. Early Access

Early Access programs offer free temporary access at our discretion and may terminate without notice. Early Access does not create any guarantee of continued free access to the Service.

11. Acceptable use

Prohibited uses include unlawful purposes, unauthorized access attempts, reverse engineering, storing malicious code, unauthorized reselling, interfering with the Service, improper use of AI features, and credential sharing outside authorized arrangements.

12. Your data

You retain ownership of your data. The Windows Connector extracts metadata locally and transmits that metadata rather than source files, cell values or query results. Uploads and supported cloud sources are processed by the service to extract metadata; source file contents are not retained. AI features receive relevant metadata and authored context, which may include descriptions and objectives containing names or figures. Team-workspace content remains under workspace administrative control. See our Privacy Policy for processing details.

13. Data security

We implement commercially reasonable technical and organizational measures to protect data but cannot guarantee absolute security for internet transmission or electronic storage.

14. Service availability

The Service is provided “as is” and “as available” without guaranteed uninterrupted access. We are not liable for outages, interruptions, delays, or errors. Rate limits exist to ensure platform performance.

15. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, MYDATAWORK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

16. Limitation of liability

MYDATAWORK'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. Indirect, consequential, and punitive damages are excluded.

17. Indemnification

You agree to indemnify and defend MyDataWork and its personnel from claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of third-party rights.

18. Intellectual property

The Service, software, design, and content belong to MyDataWork, LLC (Delaware) and are protected by intellectual property laws. You receive limited usage rights only.

19. Modifications to the Service and Terms

We may modify or discontinue the Service with or without notice. Material changes to these Terms are communicated via the website or email. Continued use constitutes acceptance of updates.

20. Termination

We may suspend or terminate accounts for violations of these Terms, fraud, or harmful conduct. Data-retention provisions apply upon termination.

21. Governing law and dispute resolution

Delaware state law governs, without application of conflict-of-law principles. Disputes are resolved by binding arbitration in Delaware, except that equitable relief may be sought in a court of competent jurisdiction.

22. Privacy Policy

Handling of personal information is governed by our Privacy Policy.

23. Entire agreement

For direct subscriptions, these Terms and any applicable written agreement describe the agreement with MyDataWork. For AWS Marketplace purchases, the accepted Marketplace agreement and its incorporated documents govern; this clause does not supersede them.

24. GovCloud service scope

The GovCloud service is hosted by MyDataWork in AWS GovCloud (US-West), not deployed into your agency’s AWS account. Workspace isolation is logical within a shared service.

AWS GovCloud hosting does not confer a government authorization on MyDataWork. MyDataWork does not claim FedRAMP or StateRAMP authorization, CMMC certification or ITAR compliance, and no agency ATO is implied. The service is not intended for classified information or Controlled Unclassified Information (CUI). Do not paste CUI, source data rows, credentials or file contents into workspace text fields.

The GovCloud application, workspace database and built-in AI processing run in AWS GovCloud (US-West). Marketplace registration and agreement events pass through a relay in commercial AWS. Transactional email delivery and recipients’ mail systems are outside the GovCloud workspace boundary. Optional cloud connections, Jira and external agents communicate with the destinations you authorize. GovCloud hosting therefore does not mean every processing path stays within GovCloud.

Applicable accepted Marketplace contract terms take precedence for that purchase. This page does not replace or retroactively change an accepted EULA.
