Terms

These Terms of Service (“Terms”) govern your access to and use of MyDataWork (“Service”), operated by MyDataWork, LLC (“we,” “us,” or “our”), a Delaware limited liability company. By registering for or using the Service, you agree to these Terms in full.

1. The Service

MyDataWork is a software-as-a-service workspace for data analysts, BI developers, data engineers, data scientists, and analytics teams. It allows users to catalog data files, track use cases and outcomes, visualize data lineage, generate AI-powered recommendations and analyses, and export portfolio reports. The Service operates through a web application and an optional local Connector application installed on your computer, with optional integrations to cloud sources including but not limited to GitHub, dbt Cloud, Databricks, and Snowflake.

2. Eligibility

You must be at least 18 years old and have the authority to enter into a binding agreement to use the Service. By using MyDataWork, you represent that you meet these requirements.

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at contact@mydatawork.com if you become aware of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized access to your account.

You may not share account credentials with parties not authorized to access your account, or use a single account to provide access to the Service to multiple individuals, except as expressly permitted by Team plan multi-seat licenses.

4. Subscription Plans and Pricing

MyDataWork offers paid subscription plans on Solo and Team tiers, available on monthly or annual billing terms. All paid plans include a 14-day free trial. You will not be charged until the trial period ends. Pricing is subject to change with reasonable notice.

Additional AI credit purchases may be available as separate, non-recurring transactions and are subject to the pricing in effect at the time of purchase.

4.5 Feature Changes

The Service is actively developed, and features may be added, modified, or removed over time. Features described at the time of subscription are not guaranteed to remain available indefinitely. We will provide reasonable notice for material reductions in functionality, but specific feature availability does not constitute part of these Terms.

5. Billing and Payment

Payments are processed securely by Stripe. We do not store your payment card information. By subscribing, you authorize us to charge your payment method on a recurring basis according to your selected plan.

Subscriptions renew automatically unless cancelled. It is your responsibility to cancel before the renewal date if you do not wish to be charged.

6. Cancellation Policy

Monthly plans: You may cancel at any time. Access continues until the end of the current billing period. No partial refunds are issued for unused time within a billing period.

Annual plans: Annual subscriptions are non-refundable. Upon cancellation, access continues until the end of the paid annual term.

You may cancel your subscription at any time through the billing management portal accessible from your Account settings.

7. Account Deletion

In addition to subscription cancellation, you may permanently delete your account from the Account section of the Service. Account deletion is immediate and irreversible. Upon deletion:

  • All workspace data, including assets, use cases, stakeholders, and progress history, will be permanently removed without the 30-day retention period that applies to subscription cancellation.
  • Any active subscription will be canceled automatically, with no refund of unused subscription periods, including but not limited to remaining time on annual plans.
  • If you are the admin of a Team plan workspace with other members, you may not delete your account until you transfer admin ownership to another member or remove all other members from the workspace.
  • Super-admin accounts cannot be deleted via self-service.

The 30-day data retention period described in Section 8 applies only to subscription cancellation, not to account deletion. We recommend exporting your data before deleting your account.

8. Data Retention After Cancellation

Following cancellation or expiration of your subscription, your account data — including assets, use cases, and workspace settings — will be retained for 30 days. After this grace period, all data associated with your account will be permanently deleted and cannot be recovered. We recommend exporting your data before cancelling.

This 30-day retention period applies to subscription cancellation only. If you delete your account via the self-service deletion flow, all data is removed immediately upon deletion as described in Section 7.

9. Early Access

From time to time, we may offer an Early Access program that provides free access to the Service for a limited period. Early Access is offered at our sole discretion and may be modified or terminated at any time without notice. Early Access does not create any guarantee of continued free access to the Service. We may, in our sole discretion, end Early Access for individual users or in its entirety with reasonable notice, and require transition to a paid plan to continue using the Service. Early Access users are subject to these Terms.

10. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to store or transmit malicious code
  • Resell or sublicense the Service without our written consent
  • Interfere with or disrupt the integrity or performance of the Service
  • Use AI features in ways that violate the terms of service of underlying AI providers, attempt to extract or reverse-engineer AI model behavior, or generate content that would violate applicable laws or third-party rights
  • Share account credentials or use a single account to provide access to multiple individuals, except as expressly permitted by Team plan multi-seat licenses

11. Your Data

You retain ownership of all data, files, and content you connect to or upload into the Service (“Your Data”). We do not claim any ownership rights over Your Data. We provide tools for you to export your complete workspace data as a JSON file at any time, supporting your right to data portability.

The local Connector application reads only file names, paths, sizes, modification dates, and structural metadata (such as column headers in spreadsheets and file type classifications) from your computer. File contents — including the actual data within files — are never accessed, transmitted, or stored by MyDataWork. Cloud source connectors (such as GitHub, dbt Cloud, Databricks, and Snowflake) similarly access only the metadata exposed by each platform’s API, not the underlying data within those systems.

When you use AI-powered features (including AI Recommendations, Leverage analysis, marketplace data discovery, migration assistance, the MyDataWork Assistant, the Workspace Agent, and the Asset Estate Assessment), the Service transmits relevant metadata — including asset names, use case descriptions, progress notes, and similar non-content information — to third-party AI service providers to generate responses. File contents are never transmitted to AI providers. By using AI features, you authorize this transmission. AI features can be disabled in workspace settings if you do not wish to use them.

For Team plan workspaces, content created or contributed by team members becomes part of the shared workspace. When a team member is removed or leaves the workspace, their contributions remain with the workspace under the workspace admin’s control. The workspace admin maintains operational ownership of the workspace and its data, even where individual contributions originated from departed members.

By using the Service, you grant us a limited license to process and store Your Data solely for the purpose of providing the Service to you.

12. Data Security

We implement commercially reasonable technical and organizational measures to protect your data. However, no method of transmission over the internet or electronic storage is completely secure. We cannot guarantee absolute security and are not liable for unauthorized access resulting from circumstances beyond our reasonable control.

13. Service Availability

We aim to provide reliable access to the Service but do not guarantee uninterrupted availability. The Service is provided “as is” and “as available.” We may perform maintenance, updates, or modifications that temporarily affect availability.

We are not liable for any damages, losses, or costs arising from Service outages, interruptions, delays, or errors, whether planned or unplanned. This includes but is not limited to loss of revenue, loss of data, or loss of business opportunity.

Certain features of the Service are subject to rate limits to ensure reliable platform performance. Current rate limits are documented in the Service’s help documentation and may be updated periodically. Users who exceed rate limits will be temporarily prevented from performing the affected action until the limit resets.

14. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, MYDATAWORK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MYDATAWORK’S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

IN NO EVENT SHALL MYDATAWORK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

16. Indemnification

You agree to indemnify, defend, and hold harmless MyDataWork and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

17. Intellectual Property

The Service, including its software, design, and content, is owned by MyDataWork, LLC, a Delaware limited liability company, and protected by applicable intellectual property laws. Nothing in these Terms grants you any rights to our trademarks, trade names, or other intellectual property beyond the limited right to use the Service as described herein.

18. Modifications to the Service and Terms

We reserve the right to modify or discontinue the Service at any time, with or without notice. We reserve the right to update these Terms at any time. We will notify you of material changes by posting the updated Terms on our website or by email. Your continued use of the Service after such changes constitutes acceptance of the updated Terms. Updates to these Terms apply prospectively only and do not affect any disputes or claims arising before the effective date of the update.

19. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any conduct we determine to be harmful to the Service or other users. Upon termination, your right to access the Service ceases immediately. Data retention provisions in Sections 7 and 8 apply.

Where reasonable and not in conflict with our enforcement of these Terms, we will provide notice of suspension or termination, including the reason and any opportunity to remedy. In cases of fraudulent activity, security threats, or material harm to other users, we may suspend or terminate without prior notice.

20. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in Delaware, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

21. Privacy Policy

Our collection, use, and protection of personal information is governed by our Privacy Policy, available at mydatawork.com/privacy-policy. By using the Service, you also agree to be bound by the Privacy Policy.

22. Entire Agreement

These Terms constitute the entire agreement between you and MyDataWork with respect to the Service and supersede all prior agreements, understandings, and representations.
